This is an application for grant of regular bail filed on behalf of the petitioner. Petitioner is in custody in connection with Complaint Case No.2909 of 2014 for the alleged offence punishable under Sections 379, 323, 498A of the Indian Penal Code and Section 3/ 4 of the Dowry Prohibition Act. Learned counsel representing the petitioner submits that petitioner has no criminal antecedent. Petitioner is the husband and marriage between the petitioner and the complainant was solemnized on 06.07.2011, i.e. approximately seven years back. The complaint was lodged in 2014. He further
Patna High Court CR. MISC. No.15975 of 2019(2) dt.14-03-2019 2/2 submits that petitioner is in custody since 26.12.2018. In paragraph-6 of the petition there is specific statement that petitioner is the husband and he is ready to keep and maintain his wife with honour and dignity.
Considering the fact that petitioner has no criminal antecedent and he is ready to keep and maintain his wife with full honour and dignity, this application is allowed. Accordingly, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM, East Muzaffarpur in connection with Complaint Case No. 2909 of 2014.
The learned court below is directed that while granting bail to the petitioner he shall refer the case to the Mediation Centre of the District so that the dispute between the parties may be amicably settled.
