JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-05-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under sections 498A/379/34 and other allied sections of the Indian Penal Code.

As per the prosecution case, when the informant and her brother went to the house of the petitioner for compromise, petitioner is alleged to have snatched chain of gold and cash Rs.6000/- from brother of the informant and threatened the informant to withdraw Buniyadganj Police Station Case No. 81 of 2020 otherwise she will be killed.

Learned counsel appearing for the petitioner submits that the petitioner is cousin mother-in-law of the victim. She is separate in mess and business. Allegation of assault is general

Patna High Court CR. MISC. No.19656 of 2023(2) dt.19-05-2023 2/2 and omnibus in nature against her.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let these petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate VI, Gaya in Buniadganj Police Station Case No. 165 of 2022, subject to the conditions laid down under section 438 of the Code of Criminal Procedure.
