Petitioner, already in custody, seeks bail, in connection with Forbesganj P.S. Case No. 479 of 2016 registered under Sections 409, 467, 468, 471 and 120(B)/34 of the Indian Penal Code.
Allegation in brief is that some interpolation made in the mutation order of the year 2008-09 and on that very basis the Revenue Clerk, Gajadhar Lal Das issued rent receipt and in this illegality the petitioner is alleged to have played the role of a middle man.
Learned counsel for the petitioner submits that petitioner is not concerned with issuing either the mutation
Patna High Court Cr.Misc. No.31830 of 2018(3) dt.27-06-2018 2/2 order or not the custodian of the said record. It has come during investigation that the petitioner is the employee of the Nagar Parishad, so no specific accusation is against him and he bears clean antecedent.
Having considered the aforesaid facts and circumstances, petitioner Amit Kumar @ Chhotu @ Chhotu Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Forbesganj P.S.
