The petitioner seeks bail in Jandaha P.S. Case No. 251 of 2021, registered for the offence punishable punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018. 300 litres of country made liquor has been recovered from a tempo of which this petitioner was one of the occupants. It is submitted that no recovery has been made from conscious possession of this petitioner. Petitioner is neither driver nor owner of vehicle in question and he is simply a copassenger. Petitioner is in custody since 08.11.2021 having no criminal antecedent, as stated in para 3 of the petition. Investigation is complete.

Considering the period of custody coupled with the
