JUSTICE SANDEEP KUMAR ORAL ORDER 03-12-2021 Heard learned counsel for the petitioner and Sri Jharkhandi Upadhyay, learned A.P.P. for the State. The petitioner apprehends his arrest in connection with Salimpur (P.R) Case No. E-86 of 2020 Special 7052 of 2020 registered for the offence punishable under Sections 30 (a), 56 (b), 32 (1), 32 (3), 41 (1) and 42 (2) of the Bihar Prohibition and Excise Act, 2018.

Huge quantity of illicit liquor totalling 4782.60 litres has been recovered from the vehicle of the petitioner. It seems that the petitioner is a member of the syndicate. In view of the fact that prima facie case under the Excise Act, is made out against the petitioner, this application for grant of anticipatory bail to the petitioner is not maintainable

Patna High Court CR. MISC. No.25380 of 2021(2) dt.03-12-2021 2/2 in view of Full Bench decision of this Court rendered in the case of Ram Vinay Yadav Vs. The State of Bihar reported in 2019 (2) P.L.J.R. 1089 (Full Bench).

Accordingly, this anticipatory bail application is dismissed as not maintainable.
