JUSTICE ASHUTOSH KUMAR ORAL ORDER 03-03-2020 The petitioner seeks bail in connection with Gaya Kotwali P.S. Case No. 574 of 2019 dated 17.12.2019 instituted for the offences under Section 147, 148, 149, 341, 323, 332, 427, 435, 436, 353, 390, 283, 188, 379 and 120B of the Indian Penal Code read with Sections 3/4 of the Prevention of Damage to Public Property Act, 1984.

The petitioner and about 5000 others had created a ruckus in the name of protest against what had happened in Jamia Millia University. It has been alleged in the FIR that the accused persons also damaged public property.

Patna High Court CR. MISC. No.13302 of 2020(2) dt.03-03-2020 2/2 Learned counsel for the petitioner submits that though he has been named in the FIR but there is no specific accusation against him except for the fact that he was part of the mob which had taken out a procession against the government. One of the accused persons of this case is reported to have been granted bail by a bench of this Court.

Regard being had to the general and omnibus nature of accusation against the petitioner and his custody which is from 18.12.2019, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Kotwali P.S. Case No. 574 of 2019.
