JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-05-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 352/385/406 and other allied sections of the Indian Penal Code.

As per the prosecution case, petitioner took complainant's Pick Up vehicle on monthly rent and after sometime he sold his vehicle.

Learned counsel appearing for the petitioner submits that the petitioner is none else but son of the complainant and due to some family dispute, this false and concocted case has been lodged by the complainant. Petitioner claims clean antecedent.

Patna High Court CR. MISC. No.15451 of 2023(2) dt.18-05-2023 2/2 Considering the aforesaid facts of the case and the relation of the parties, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class Motihari, East Champaran in Complaint Case No. 1457 of 2017/Trial No.1025 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
