The petitioner seeks bail in a case registered for offences under Section 30 (A) of the Bihar Prohibition and Excise Act, 2016.

It is contended that as per allegation, 90 bottles each containing 300 ml, i.e., total 27 litres of Nepali Soufi wine were allegedly recovered from the possession of the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 13.07.2017.

Considering the facts and the circumstances of the case, the petitioner, above named is directed to be released

Patna High Court Cr.Misc. No.39868 of 2017(2) dt.25-08-2017 2/2 on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise Act, Sitamarhi in connection with Official Complaint Case No. C-2/416 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
