Petitioner, already in custody, seeks bail in connection with Bihiya PS Case No.315 of 2017, registered under Sections 147, 148, 149, 323, 307, 302 and 120(B) of the Indian Penal Code as well as under Section 27 of the Arms Act. Learned counsel for the petitioner submits that the petitioner has falsely been implicated due to land dispute and no specific overt act is alleged against him rather the specific allegation of shooting at the deceased, Manoj Thakur is against Angad Thakur and one Din Dayal is also said to have opened fire causing injury in the left hand and this petitioner has no criminal antecedent.

Having considered the aforesaid facts and

No.30837 of 2018(3) dt.18-05-2018 2/2 circumstances, petitioner Dhanu Thakur @ Bhanu Thakur is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-V, Bhojpur, Ara in connection with Bihiya PS Case No.315 of 2017.
