The petitioner being the husband of the complainant's daughter is apprehending his arrest in a complaint case in which processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 498A, 494 of the Indian Penal Code. The basic accusation is of torture and performing second marriage.
A supplementary affidavit has been filed on behalf of the petitioner to the effect that issue has been resolved between the parties and both decided to part ways of payment of one time settlement amount of Rs. 50,000/-. Three drafts of
Patna High Court Cr.Misc. No.23707 of 2015 (8) dt.05-04-2016 Rs. 13,000/-, 17,000/- and 20,000/- have been handed over to the counsel for the opposite party no. 2.
Learned counsel for opposite party no. 2 is not disputing the contention of the learned counsel for the petitioner and is not opposing the prayer for bail of the petitioner. Learned counsel for opposite party no. 2 is making necessary endorsement on the record.
Considering the present stand of the parties, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Khagaria in connection with Complaint Case No. 1341C of 2013, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
