Mr. Arun Kumar Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-07-2025 Heard learned counsel appearing on behalf of the petitioner and learned A.P.P. appearing on behalf of the State.

2. The petitioner apprehends her arrest in a case registered for the offence punishable under Sections 302, 201 and 34 of the Indian Penal Code.

3. As per prosecution case, informant, namely Chanchal Kumari, alleged that on 27.05.2023, her 6 years old son went missing after school and he was last seen playing with this petitioner. It is further alleged that later on, the child's dead body was found near the pond.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. Petitioner has falsely been implicated in this case on account of malice of the informant to ventilate the

Informant is not an eye-witness to the alleged occurrence and only suspicion has been raised against this petitioner causing a roving investigation to ascertain the death of her son. Petitioner and her husband had no motive to cause death of son of informant and they have no role to play in the alleged occurrence. Petitioner is a lady and claims clean antecedents.

5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that petitioner is named in the F.I.R. with specific accusation that the deceased was last seen with this petitioner.

6. Considering the facts and circumstances of the case and specific and direct nature of accusation, the prayer for grant of anticipatory bail to the petitioner is rejected. (Prabhat Kumar Singh, J) shashank/- U T
