Heard learned counsel for the petitioners and the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 357 and 480 of the Indian Penal Code.

Prosecution case is that the grains were stolen from the house of the informant worth Rs. 40,000/-. During course of search one bag of paddy was found near the house of co-accused Saroj Paswan. The suspicion was raised against the petitioners on suggestions of others. Further case is that the petitioners failed to attend the panchayati.

It is submitted by the learned counsel for the

Patna High Court Cr.Misc. No.21385 of 2015 (2) dt.23-06-2015 petitioners that only on suspicion the accusation has been levelled. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Pakribrawan P.S. Case No. 27 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
