Petitioner is languishing in judicial custody since 14.06.2017 in connection with Barbigha P.S. Case No. 219 of 2017 for offences punishable under Sections 272, 273, 414, 467, 420, 468, 188 of the Indian Penal Code and Section 30 of the Bihar Prohibition of Excise Act.

The prosecution case, as lodged by the police personnel, is that on raid in the house of one Arvind Tripathi 84 liters of foreign liquor was recovered.

It has been submitted by the learned counsel for the petitioner that he is innocent, nothing has been recovered from his conscious possession and that the co-accused Arvind Tripathi has been

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional District and Sessions Judge, Sheikhpura in connection with Excise Case No. 386 of 2017 arising out of Barbigha P.S. Case No. 219 of 2017.
