The petitioner seeks bail in a case registered under Sections 341, 323, 307/34 of the Indian Penal Code. Allegation is that the petitioner and three unknown assaulted the son of the informant by cricket bat, due to which he sustained injury on his head.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 23.12.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. While playing cricket due to some altercation, cricket bat is said to have been used by the petitioner. The petitioner had no intention to commit murder of the victim. There was no premeditation of mind. No offence

Patna High Court CR. MISC. No.15666 of 2020(2) dt.06-03-2020 2/2 under Section 307 of the I.P.C. is made out.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- cum-Sub Judge VIII, Patna in connection with Patrakar Nagar P.S. case No.1083 of 2019.
