The petitioner being the cousin of the husband of the victim is apprehending his arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

The prosecution case is that the daughter of the informant namely Babita Devi was married with Shiv Shankar Ram in the year 1993. The daughter of the informant was being tortured and assaulted by the petitioner and ultimately she was strangulated on 14.10.2015. It is further alleged that one day prior to the death Mahendra Ram asked the informant to take back

It is submitted by the learned counsel for the petitioner that petitioner is not named in the First Information Report. The name of the petitioner sprang up in the subsequent statement of the informant.

The investigation with regard to First Information Report named accused persons has already been concluded and chargesheet has been submitted under Section 306 of the Indian Penal Code. So far as investigation against petitioner is concerned, it is still pending.

Considering the aforesaid facts, let the above named petitioner be released on bail till conclusion of investigation in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Asthawan P.S. Case No. 164 of 2015, subject to conditions as laid down under Section 438(2) of the Indian Penal Code. The bail bond of the petitioner shall be accepted by the learned court below on filing affidavit to the effect that he will cooperate during investigation.
