====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 17-11-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Patna Kotwali P. S. Case No.497 of 2020, instituted for the offences under Sections 379 of the Indian Penal Code and charge-sheet was submitted under Sections 379, 411, 34 of the I.P.C. The learned counsel for the petitioner submits that petitioner is in custody since 15.12.2020 and he claims to be a person of clean antecedents. Charge-sheet has been submitted in this case.

From bare perusal of the F.I.R., it would manifest that petitioner has been falsely implicated in this case as his name has come in the confessional statement of co-accused Nitesh

Patna High Court CR. MISC. No.25691 of 2021(2) dt.17-11-2021 2/2 Kumar with regard to committing theft of scooty of the informant.

Learned A.P.P. vehemently opposes the paryer. Considering the clean antecedents of the petitioner and charge-sheet has been submitted in this case and petitioner is in custody since 15.12.2020, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Patna Kotwali P. S. Case No.497 of 2020.

The application stands allowed.
