2. The petitioner prays for regular bail in connection with Ghogha P.S. Case No. 94 of 2024 registered under Sections 137(2), 103(1), 238,3(5) of the B.N.S. Act.

3. The prosecution case is to the effect that brother of the informant namely, Pankaj Kumar is said to have been called by one Sudarshan Mandal and after some talk there was some verbal altercation with regard to a girl. The informant has suspected that the said Sudarshan Mandal has committed the murder of his brother Pankaj Kumar.

4. The learned counsel for the petitioner submits that he is innocent and has been falsely implicated in the present case. It has been stated that the petitioner was not named in the FIR and his name has surfaced in the confessional statement of the coaccused Sudarshan Mandal. The learned counsel has also stated

Patna High Court CR. MISC. No.88449 of 2024(4) dt.21-04-2025 2/2 that the similarly situated co-accused namely, Ajay Kumar has been enlarged on bail vide order dated 06.02.2025 passed in Cr. Misc. No. 82166 of 2024 as also another co-accused namely, Aditya Raj has been granted bail vide order dated 11.02.2025 passed in Cr. Misc. No. 84983 of 2024. The learned counsel submits that the case of the present petitioner is exactly similar to the aforesaid two co- accused persons.

5. The learned APP for the State has opposed the prayer for bail and has stated that the said co-accused Sudarshan Mandal has specifically named the petitioner to be his associate and has even attributed specific roles to the petitioner.

Considering the aforesaid facts and circumstances of the case and also considering the fact that the similarly situated co-accused persons have been granted bail by the Co-ordinate Benches of this Hon'ble Court, let the petitioner be released on bail furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VIII, Bhagalpur in connection with Ghogha P.S. Case No. 94 of 2024.
