JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-02-2016 The petitioner being husband of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 323, 341, 379, 498A, 504, 34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
The basic accusation is of torture for nonfulfilment of dowry demand. On the joint prayer of the parties, the matter was referred to the Mediation & Conciliation Centre of the State Legal Services Authority vide order dated 05.10.2015. The report of the mediator at Flag-A dated 12.01.2016 reflects that the issue has been resolved between the parties and petitioner agreed to make payment of Rs.75,000/- as settlement amount in three installments within a period of three months from the
Patna High Court Cr.Misc. No.21901 of 2015 (6) dt.04-02-2016 2/2 date of agreement dated 08.01.2016.
Learned counsel for the informant/O.P. No. 2 accepts the terms of the agreement arrived at between the parties before the Mediator.
In the circumstance, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Darbhanga in connection with Manigachhi P.S. Case No. 99 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
Either side will be at liberty to file appropriate application if either party violates the terms of agreement arrived at before the Mediation Centre.
