JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-04-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 341, 323, 307 and 504 of the Indian Penal Code.

On 13.12.2015 the accused persons including the petitioner came variously armed when co-accused Rajo Yadav assaulted with garasa on the head of Sumkan singh, Jitendra Yadav assaulted on the head of Bhagwat Sao and the petitioner Chhotelal Yadav assaulted with garasa on the head of the informant.

It is submitted by learned counsel for the petitioner that the injury of the informant has been found to be simple in nature caused by hard and blunt substance. There is counter version of the occurrence also. A statement has been made in para 3 of the

Patna High Court Cr.Misc. No.15024 of 2016 (2) dt.11-04-2016 2/2 petition that the petitioner has no criminal antecedent. Considering the accusation against the petitioner not being corroborated by the medical opinion, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nawada in connection with Akbarpur P.S. Case No. 270 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
