JUSTICE SANDEEP KUMAR ORAL ORDER 08-08-2023 At the very outset, Mr. Shamsi, learned counsel appearing on behalf of the petitioners has drawn my attention to the order dated 25.01.2018 passed in Cr. Misc. No. 20782 of 2012 and has submitted that out of the five accused in the complaint case, three had moved this Court for quashing the order dated 21.03.2009. However, with regard to the two petitioners, their cases were allowed vide the aforementioned order dated 25.01.2018 passed in Cr. Misc. No. 20782 of 2012. Learned counsel for the petitioners further submits that the case of these three petitioners is same and similar with the two
Patna High Court CR. MISC. No.31906 of 2018(3) dt.08-08-2023 2/2 petitioners of Cr. Misc. No. 20782 of 2012.
2. Learned Additional Public Prosecutor has not been able to point out any distinction between the cases of the petitioners who had earlier come to this Court and the present three petitioners.
3. Considering the submissions of the parties and for the grounds mentioned in the order dated 25.01.2018 passed in Cr. Misc. No. 20782 of 2012, this application is also allowed.
4. The prosecution of the present three petitioners are hereby quashed.
