JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 414 of the Indian Penal Code.

On information that one Rohit Kumar deals with stolen vehicles, a raid was laid and from the house of Rohit Kumar two suspected stolen Hero Honda motorcycles were recovered, who in his confession disclosed name of other accused persons including the petitioner. On the basis of confessional statement of Rohit Kumar, scrap shop of one Paramhansh Rai was raided from where stolen motorcycle's parts were recovered, one Hero Honda motorcycle was recovered from the house of co-accused Mukesh Singh, two hero Honda Motorcycles were recovered from the house of Ram Babu Singh and from the house of Sunil Kumar one mobile and

Patna High Court Cr.Misc. No.21039 of 2015 (2) dt.19-05-2015 2/2 one Super Splendor motorcycle were recovered. It is submitted by learned counsel for the petitioner that there is no recovery from the petitioner and only confession of coaccused Rohit Kumar petitioner has been roped in the present case. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Dalsingsarai (Samastipur) in connection with Ujiyarpur P.S. Case No.144 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
