2. The petitioner seeks bail in connection with Nadi P.S. Case No. 348 of 2024 instituted for the offences under Sections 190, 191(2), 191(3), 126(2), 115(2), 117(2), 109, 76, 303(2), 329(4), 352, 351(2), 351(3) of the B.N.S.
3. As per prosecution case, the accusation against the accused persons including the petitioner is of brutally assaulting the Informant, her husband and her daughter-in-law with an intention to kill them due to which they sustained injuries. It is also alleged that the accused persons also taken away money and ornaments from the box kept in the house of the Informant.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.14423 of 2025(2) dt.17-03-2025 2/3 petitioner is innocent and has committed no offence as alleged against him and has falsely been implicated in the present case. The petitioner has not committed any offence as alleged in the F.I.R. There is a case and counter case between the parties. The present case is counter case of Nadi P.S. Case No. 349 of 2024. Learned counsel for the petitioner submits that there is no direct or specific allegation of any overt act against the petitioner rather the same is general and omnibus in nature. The specific allegation of assault is against the co-accused Dharmendra Rai and Pawan Kumar. The petitioner has no criminal antecedent and is languishing in judicial custody since 20.11.2024 without any rhymes or reason. Charge-sheet has been submitted in this case.
5. On the other hand, learned A.P.P. for the State and the Informant have vehemently opposed the prayer for grant of bail to the petitioner, stating that the offence alleged against the petitioner is serious in nature. The petitioner is named in the F.I.R. and, hence, he does not deserve bail.
6. Having heard rival contention of both the parties and considering the entire facts and circumstances of the case, the period of custody of the petitioner, the petitioner having no criminal antecedent as also there being no specific allegation of

No.14423 of 2025(2) dt.17-03-2025 3/3 any overt act against the petitioner, let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Nadi P.S.
