====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-05-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. Petitioners seek regular bail in connection with Belaganj P. S. Case No. 168 of 2021 in a case registered for the offences punishable under Sections 147, 149, 341, 323, 504, 302 of the Indian Penal Code.

3. Prosecution case, in brief, is that on 8.6.2021 at about 8 AM, on account of land dispute all the 24 named accused persons including these petitioners, variously armed, came and started assaulting informant and his family members as a result of which, father of the informant sustained injury and during course of treatment, he died.

4. Learned counsel for the petitioners submits that both parties are next-door neighbours and on account of admitted land dispute between the parties, this false and concocted case has been lodged. Allegation of assault against petitioners is general and omnibus. It is further submitted that similarly situated co-accused persons have already been granted bail by co-ordinate Benches of this Hon'ble Court vide Annexure-P3 Series. Petitioners are in custody since 24.12.2024.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the nature of allegation and period of custody, the bail application is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Gaya in connection with Belaganj P. S. Case No. 168 of 2021.
