JUSTICE SANJAY PRIYA ORAL ORDER 2/ 27-02-2019 This application has been filed for modification in the cause title of order dated 25.09.2018 passed in Cr. Misc. No.51134 of 2018 by which petitioner has been granted bail in connection with Karakat P.S. Case No.43 of 2018 to the satisfaction of the Sub-Divisional Judicial Magistrate, Bikramganj, Rohtas, in respect of father's name of petitioner. Counsel for the petitioner submits that in the bail petition, petitioner has mentioned his father's name as 'Rama Shankar Yadav' and the same has been typed in the cause title of the order dated 25.09.2018 passed in Cr. Misc. No.51134 of 2018. Counsel for the petitioner further submits that father's name of petitioner has been mentioned as 'Rameshwar Singh' in para 19 and 36 of the case diary. Patna High Court CR. MISC. No.12205 of 2019(2) dt.27-02-2019 2/2 submits that alias name of petitioner's father, namely, "Rameshwar Singh" be also incorporated with Rama Shankar Yadav in the cause title of the order dated 25.09.2018 passed in Cr. Misc. No.51134 of 2018.
In such circumstances, the Court below will hold necessary enquiry after seeking report from the concerned Police Station about correct father's name of the petitioner. If in the report of the police, it comes that father's name of this petitioner is Rameshwar Singh @ Rama Shankar Yadav, then the Court below will act accordingly.
This Modification Application is, accordingly, disposed off.
