JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-07-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State and learned counsel for the informant.

Petitioner no. 1 is mother-in-law whereas petitioner no. 2 is married sister-in-law of the deceased and petitioners apprehend their arrest in connection with Bangaon Police Station Case No. 97 of 2014 registered for the offences punishable under Sections 304B,120B/34 of the Indian Penal Code. It is admitted case of the prosecution that the informnat's son claimed to have seen the husband of the deceased assaulting the deceased on 30.10.2014 and after that deceased died on 31.10.2014. Furthermore, it is also an admitted case of the

Patna High Court Cr.Misc. No.21047 of 2015 (2) dt.02-07-2015 2/2 prosecution that prior to her death the deceased was taken to hospital by her in-laws family members.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in Bangaon Police Station Case No. 97 of 2014, subject to condition as laid down under Section 438(2) of the Cr.P.C.
