This is an application for bail in connection with Janta Bazar P.S.Case No. 124 of 2017 registered for the offences punishable under 30 of Bihar Excise Act.

Allegation is of recovery of 303.84 litres of liquor. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and nothing has been recovered from his possession and he is in custody since 23.7.2017 having criminal antecedents but not relating to similar type of cases.

Having heard both sides and in view of facts and circumstances, this application is disposed of with a direction to

Patna High Court Cr.Misc. No.44465 of 2017 (2) dt.15-09-2017 2/2 the court below that once charge has been framed or petitioner completes three months period in judicial custody, whichever is earlier, the court below will release the petitioner on bail to its own satisfaction, if application for bail on behalf of petitioner is filed.
