2. The petitioner is apprehending his arrest in connection with Baligaon Sarai P.S. Case No. 129 of 2024, F.I.R. dated 19.09.2024 for the offences punishable under Sections 137(2), 96 of the Bharatiya Nyay Sanhita, 2023.
3. According to prosecution case, the informant alleged that the petitioner kidnapped her daughter.
4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case. He further submits that the
Patna High Court CR. MISC. No.15382 of 2025(3) dt.15-05-2025 2/2 allegation as alleged in the F.I.R. is false and fabricated and the petitioner has not committed any offences as alleged in the F.I.R infact the informant had herself kidnapped her daughter and falsely implicated the petitioner in the present case and apart from that date of occurrence as alleged in the FIR is 13.09.2024 but the present FIR was instituted on 19.09.2024 i.e. after delay of six days without giving any explanation of delay.
5. The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner and submits the petitioner had kidnapped the daughter of the informant and till date the victim has not been recovered.
6. Considering the aforesaid facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner in connection with Baligaon Sarai P.S. Case No. 129 of 2024 pending in the court of learned Judicial Magistrate-1st Class, Vaishali, Hajipur.
7. Prayer is refused.
