The petitioner seeks bail in G.R. Case No. 292/2017, arising out of Bakhtiarpur P.S. Case No. 63/2017, instituted for offence under Section(s) 302 and 34 of the Indian Penal Code read with Section 27 of Arms Act.

Learned counsel for the petitioner has submitted that petitioner is not named in the written report. Name of this petitioner has come in the confessional statement of co-accused Dharmendra Kumar.

It is alleged in the written report that informant along with her husband had gone to Patna. On the date of occurrence, informant got telephonic message that someone has killed her

Patna High Court CR. MISC. No.17462 of 2019(2) dt.26-03-2019 2/2 son Bitu Kumar. Thereafter informant along with other family members reached at her village and found dead body of her son lying near Middle School. She learnt that 3-4 unknown persons had killed her son.

Petitioner is in custody since 13.09.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Barh, in connection with G.R. Case No. 292/2017, arising out of Bakhtiarpur P.S. Case No. 63/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
