Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner is in custody since 26.10.2019 and seeks bail in connection with Bihiyan P. S. Case No.380 of 2019 registered for the offences punishable under Section 414 of the I.P.C. and Section 25(1)-B(a)/26/35 of the Arms Act. The informant claims that petitioner was using looted mobile of Jagdishpur P. S. Case No.307 of 2019 and having got aforesaid information, he raided the house of the petitioner and apprehended the petitioner. On being searched, one country-

Case No.307 of 2019 were recovered from the possession of the petitioner and, furthermore, on the basis of confessional statement of the petitioner, the house of the other co-accused was raided and, moreover, other accused was also caught and firearms as well as other articles were also recovered from their possession.

Considering the aforesaid facts and circumstances of the case as well as this aspect of the matter that except the present case as well as Jagdishpur P. S. Case No.307 of 2019, there is no any criminal antecedent of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XIIth, Bhojpur in connection with Bihiyan P. S. Case No.380 of 2019.
