JUSTICE PURNENDU SINGH ORAL JUDGMENT Date : 26-07-2023 Heard Mr. Kamod Kumar Vidyarthi, learned counsel appearing on behalf of the petitioner; Mr. Gyan Prakash Ojha, learned GA-7 along with Mr. Abhishek Singh, learned counsel for the State and Mrs. Nivedita Nirvikar, learned counsel for the Accountant General.

Learned counsel appearing on behalf of the petitioner informs this Court that all the retiral dues have been paid to the petitioner along with statutory interest in accordance with law, however, the amount accrued on account of Group Insurance has not been paid till date. He submits that the controlling officer of the petitioner is Director, Social Welfare Department, Bihar - respondent no.2. He is the one who has

Patna High Court CWJC No.3982 of 2023 dt.26-07-2023 2/2 delayed in making payment of Group Insurance to the petitioner.

3. The Director, Social Welfare Department, Bihar is directed to ensure to make payment of entire amount on account of Group Insurance accrued to the petitioner. In case he finds that certain forms are required to be filled up by the petitioner, he must depute a responsible officer who will make the petitioner acquainted with all the requirements and paraphernalia required in filling up forms etc. so that properly filled up forms can be forwarded by the Director, Social Welfare to the Insurance Company.

4. The above exercise is expected to be undertaken within two weeks so that the payment is credited into the bank account of the petitioner within a period of three weeks.

5. With the above observation and direction, the present writ petition is disposed of.

6. In case of failure, petitioner is at liberty to take appropriate legal action against the Director, Social Welfare Department, Bihar.
