JUSTICE MADHURESH PRASAD ORAL JUDGMENT Date : 16-04-2019 Heard counsel for the petitioner and the respondents. The petitioner was an applicant for appointment on the post of constable pursuant to Advertisement no. 1 of 2014. Petitioner has annexed his admit card for written examination (Annexure 1) as well as call letter for physical verification (Annexure 2). The final result for the process of selection was published thereafter where the petitioner was not declared successful and has not been selected.
The claim of the petitioner in his representation dated
Patna High Court CWJC No.6971 of 2015 dt.16-04-2019 2/2 06.04.2015 (Annexure 5 of the writ petition) as well as pleadings in the writ petition are to the effect that the cut of date for the qualification of intermediate 01.01.2014 would not be made the basis of rejecting the petitioner's candidature since by the time the result was issued, his intermediate result has been published.
Such submission is not tenable. If the cut of date 01.01.2014 was uniformly prescribed for acquiring the degree of intermediate then a certificate subsequent to that date cannot be considered in support of petitioner's candidature ignoring the cut of date. The petitioner was not declared successful in the process of selection and such relaxation of uniformly applicable criteria cannot be granted to the petitioner.
