This application is filed for grant of regular bail in connection with G.R. No. 6050 of 2022 (arising out of Balia Belon P.S. Case No. 148 of 2022), registered under section 30(a) of the Bihar Prohibition and Excise Act, 2018. Learned counsel for the petitioner submits that there is recovery of 191.7 litres of illicit foreign liquor. The petitioner is in custody since 27.11.2022.
Learned A.P.P. has vehemently opposed the prayer for bail.
Considering the period of custody and the quantum of
Patna High Court CR. MISC. No.15948 of 2023(2) dt.22-05-2023 2/2 liquor recovered, this application for regular bail is allowed. Let the petitioner, above named, be released on bail after framing of charge if the charge is not framed yet and on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise Court No. 1, Katihar in connection with G.R. No. 6050 of 2022 (arising out of Balia Belon P.S. Case No. 148 of 2022).
The petitioner will visit Manshi (Karia) Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
