2. The petitioner is in custody in a case registered for the offence punishable under Sections 8(c) & 21(a) of the NDPS Act.
3. As per allegation in the FIR, it is alleged that from the pocket of petitioner 1.0 gram smack kept in two small plastic box and one mobile phone were recovered.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that nothing has been recovered from the conscious possession of the petitioner and alleged seized smack is very small quantity and petitioner is in custody since 08.01.2025.

5. Learned APP for the State opposes the prayer for bail of the petitioner.
6. In view of the aforesaid submissions as well as the fact that the seized smack is very small quantity, so let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Vaishali at Hajipur in connection with Mahnar P.S. Case No. 03 of 2025, subject to the condition that the petitioner shall remain physically present on each and every date fixed by the learned trial Court.
