====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 02-03-2020 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case for the offence registered under Sections 341, 342, 354(B)/34 of the IPC and Section 66 (C) of the Information Technology Act. The prosecution story, in brief, is that the petitioner and others posted a video on the Facebook showing obscenity of the female.

It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 20.10.2019. The petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. There is no substantive evidence

Patna High Court CR. MISC. No.14343 of 2020(2) dt.02-03-2020 2/2 to suggest the implication of the petitioner in the present case. Other co-accused accused has been granted bail by another Coordinate Bench of this Court vide Cr. Misc. No. 6712 of 2020 under order dated 04.02.2020 annexed as Annexure-3 to the present case.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M.
