08-05-2018 Heard Sri Mukesh Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. Two petitioners, having clean antecedent, which fact has been stated in paragraph 3 of the petition, have prayed for grant of bail in Industrial Area P.S. Case No. 44 of 2018 registered for offence under Sections 414/34 of the Indian Penal Code and Section 30 of Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioners submits that in the case, recovery of huge quantity of Indian make foreign liquor was shown from a tractor garage of one Raj Kumar Das and both the petitioners were apprehended, as if, they were also present in the garage. The petitioners have falsely been

Considering the nature of accusation, clean antecedent as well as the fact that recovery was affected from the garage of co-accused Raj Kumar Das, let both the petitioners namely Pankaj Kumar Das and Aditya Raj @ Chhotu be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge II cum Special Judge (Excise Act), Vaishali at Hajipur in connection with Industrial Area P.S. Case No. 44 of 2018.
