This is an application for bail in connection with Nokha P.S. Case No. 97 of 2017, registered for the offences punishable under Sections 120B of the Indian Penal Code and 25(1-B)(a), 26 and 35 of the Arms Act.

Allegation is of recovery of one country made pistol and two cartridges and it further appears that petitioner is accused in three other cases.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and he is in custody for seven months and further submission is that petitioner undertakes to abide by any condition that may be imposed on him by this Court, if bail is granted.

Having heard both sides and in view of facts and

No.47985 of 2017 (3) dt.08-11-2017 2/2 circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Rohtas, Sasaram, in connection with Nokha P.S.Case No. 97 of 2017, subject to the conditions as follows :

(1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner will mark his attendance in local police station in first week of every month at least for one year so that police may watch his conduct during the said period, failing which his bail bond shall be cancelled.

Let this order be communicated to the Superintendent of Police, Rohtas for its compliance.
