2. The petitioner is apprehending his arrest in connection with Complaint Case No. 334 of 2023 registered for the offence under Sections 341, 323, 498(A) and 34 of the Indian Penal Code, lodged by the complainant Bashanti Kumari.

3. As per the prosecution story, the complainant alleged that she got married in the year 2021 but was tortured for dowry and then thrown out. This led to the case.

4. Earlier, both the coordinate Bench as also this Court tried to solve the problem but the attitude of the petitioner clearly shows that he is not ready to come to terms, the only live

2/4 that has been extended by him is that the petitioner is ready to pay Rs.6,000/- in the account of the opposite party no.2 by 10th of every month, if granted relief and failure to do so, steps can be taken for cancellation of his bail bond.

5. Learned counsel representing the informant submits that she is a poor lady having no parental financial support and the amount is to be fixed considering the prices of the items.

Considering the attitude of the petitioner, at on point of time, this Court wanted to reject the petition, however, in view of the fact that he has shown some inclination to give financial support to the lady, the case is there, he shall be facing the music, in that background, this Court is inclined to extend him the privilege of anticipatory bail subject to payment of Rs.6,000/- per month in the account of the opposite party no.2 which must come by 10th of every month. Failure to do so, the State/opposite party no.2 shall be taking immediate steps for cancellation of his bail bond.

7. Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the

3/4 satisfaction of learned Chief Judicial Magistrate, Rosera, Samastipur, in connection with Complaint Case No. 334 of 2023 subject to the conditions as laid down under Section 438(2) of the Cr.P.C., as also with the following conditions:- (i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his/her bona fide;

(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his/her bail bond by the Trial Court itself;

(iii) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of bail bonds.

8. So far as the no support from the parent is concerned, this Court directs the Block Development Officer, Hasanpur, Samastipur under whose jurisdiction the lady is residing to look into the matter and ensure that she is attached to

4/4 any Jeevika Society for her livelihood.

9. The Block Development Officer, Hasanpur, Samastipur, shall be personally supervising the entire matter and shall be submitting a short report in this context with the Court through Mr. Jitendra Kumar Singh, learned APP. Let the name of Mr. Jitendra Kumar Singh, learned APP appear in the cause list.

10. Let the matter come up under the heading 'To Be Mentioned' on 16.01.2026, when learned APP shall be providing a report from the Block Development Officer, Hasanpur, Samastipur.
