The petitioner seeks regular bail in connection with Saharsa P.S. Case No. 399 of 2017, for the offences punishable under section 392 of the Indian Penal Code.

The learned counsel for the petitioner submits that there is recovery of a mobile and a sum of Rs. 7,000/- from the possession of the petitioner. However, nothing incriminating has been recovered so as to connect him with the alleged offence. It is further submitted that he has been roped on the basis of the confessional statement of one Md. Haidar.

The argument of the learned counsel for the petitioner is that the petitioner otherwise has a clean antecedent. However,

Patna High Court Cr.Misc. No.37649 of 2017 (2) dt.10-08-2017 he has been remanded in three other cases after being arrested in the present case.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner Mukesh Kumar @ Mukesh Kumar Sah @ Jagta @ Jagat @ Raja on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa P.S. Case No. 399 of 2017.
