2. The petitioner is apprehending arrest in connection with Madhuban P.S. Case No. 42 of 2024 registered on 03.02.2024 for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 337, 325, 307, 332, 333, 353, 427, 504 and 506 of the Indian Penal Code and Sections 3 and 4 of the Prevention of Damage to Public Property Act.
3. As per prosecution, the F.I.R. has been lodged against 46 named and 40-50 unknown accused persons against whom there is an allegation that they have attacked the police party.
4. It is submitted by learned counsel for the petitioner that the petitioner is innocent and has committed no offense. He

No.15524 of 2025(2) dt.02-04-2025 2/2 further submits that the entire allegation in the F.I.R. is general and omnibus, and that the petitioner's name has been included in the present case at the instance of the local Chaukidar. He further submits that similarly situated co-accused have been granted bail by a co-ordinate Bench of this Court vide order dated 29.07.2024 in Criminal Miscellaneous No. 43441 of 2024, and vide order dated 20.08.2024 in Criminal Miscellaneous No. 33296 of 2024 respectively. The antecedents of the petitioner are clean.
5. Learned APP for the State opposes the prayer for bail of the petitioner.
6. In the facts and circumstances, let the above named petitioner be released on bail, in the event of arrest or surrender before the Trial Court within a period of four weeks from today, on furnishing bail bond of ₹30000/- (thirty thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, First Class, East Champaran, Motihari, in connection with Madhuban P.S. Case No. 42 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dr. Anshuman, J) Ashwini/- U T
