JUSTICE BIRENDRA KUMAR ORAL ORDER 07-05-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 323/341/376/511/504/506 of the Indian Penal Code and Section 8 of the POCSO Act. According to FIR, allegation of attempt to commit rape is against co-accused Bittu Kumar @ Khaini. When the complaint of aforesaid occurrence was made the petitioner and coaccused Bijendra Singh allegedly abused and assaulted to the informant.

Submission is that Bijendra Singh was already allowed anticipatory bail in Cr. Misc. No.26454 of 2018 by a coordinate Bench of this Court.

Patna High Court Cr.Misc. No.27533 of 2018 (2) dt.07-05-2018 P2/ Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Azimabad P.S. Case No.1 of 2018, POCSO Case No.6 of 2018, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
