Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 307, 323, 436, 504 of the Indian Penal Code. The accusation is putting the dwelling hut of the informant on fire and assaulting the informant and informant's family members.

It is submitted by learned counsel for the petitioner that petitioner is regular student of final year of Gyan Ganga Institute of Technology and Management, Bhopal and on the alleged date of occurrence the petitioner was at Bhopal and the certificate to that effect was issued by the Principal of the college which was verified by the I.O of the case. The said certificate has been brought on record as Annexure-3. Moreover the alibi of the other accused persons against whom there is

Patna High Court Cr.Misc. No.21908 of 2015 (2) dt.24-06-2015 2/2 specific accusation of assault namely Baliram Yadav has been granted anticipatory bail. The accusation is omnibus and general against the accused persons.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Siwan Muffasil P.S. Case No. 165 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
