JUSTICE SANJAY PRIYA ORAL ORDER 27-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Pauthu P.S. Case No. 33 of 2017 instituted for the offence under Sections 366A, 120(b) and 34 of the Indian Penal Code.
It has been submitted that petitioner is not named in the written report. The name of this petitioner has been disclosed by the victim girl in her statement recorded under Section 164 Cr. P.C.
The statement of victim girl recorded under Section 164 Cr. P.C. has been enclosed as Annexure-2 wherein she has not levelled any allegation of committing illegal act with her against the petitioner.
Considering the aforesaid facts and circumstances of
Patna High Court Cr.Misc. No.35415 of 2017 (2) dt.27-07-2017 2/2 the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Aurangabad, in connection with Pauthu P.S.
