1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 191(2), 191(3), 190, 329(3), 115(2), 118(1), 109, 132, 125(a), 125(b) and 352 of the BNS as well as Sections 8(c), 21(B) and 29 of the NDPS Act.

3. Learned counsel for the petitioner submits that petitioner has antecedent of three cases and the informant alleges that on information the police force reached the place of occurrence and apprehended Vicky Kumar with 9.700 grams of smack. Further, 5-6 persons came and tried to free Vicky and thus assaulted the police personnel by lathi, danda causing injury to three policemen. Further, Vicky disclosed the name of the petitioner and Karu and confessed that he sells smack with them.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is further submitted that petitioner is own brother of Vickey. It is next submitted that since petitioner is own brother of Vickey, as such, the informant implicated him in the instant case.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner and submits that petitioner has antecedent of three cases and there is specific allegation in the FIR that 5-6 persons came and assaulted the police personnel leading to injury and the apprehended accused Vickey disclosed the name of the person who fled after committing the occurrence. It is further submitted that why Vickey would falsely implicate his own brother.

6. Considering the submissions made by the learned A.P.P., the Court is not inclined to extend the privilege of anticipatory bail to the petitioner in connection with Ganga Bridge P.S. Case No. 246 of 2024 pending in the Court of learned Principal Sessions Judge, Vaishali at Hajipur/Successor Court.

7. Hence, the prayer for anticipatory bail is rejected. (Satyavrat Verma, J) Kundan/- U T
