JUSTICE MOHIT KUMAR SHAH ORAL ORDER 10-08-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Vaishali P.S. Case No. 89 of 2017, registered for the offence punishable under Sections 379 and 411 of the Indian Penal Code.

The case of the informant is that his motorcycle was stolen on 24.12.2015. However, when he had gone to Vaishali Mahautsav, he found two persons riding his motorcycle and when he apprehended them, the police had come and caught the accused persons.

The learned counsel for the petitioner submits that the petitioner is innocent and has got no criminal antecedent. It is further submitted that co-accused person has already been

Patna High Court Cr.Misc. No.37781 of 2017 (2) dt.10-08-2017 granted regular bail by this Court by an order dated 27.07.2017 passed in Criminal Miscellaneous No. 27951 of 2017. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Vaishali P.S. Case No. 89 of 2017.
