The petitioner seeks regular bail in connection with Konch P.S. Case No.03 of 2018 registered for the offences punishable under Sections 386/34, 353 and 120(B) of the Indian Penal Code and Section 3⁄4 of Explosive Substance Act and Section 17 of C.L.A. Act.

The informant being police officer got information regarding concealment of explosive substance under the ground covered by soil behind the house of the petitioner and on search made by police party, the explosive substances were found there. It is alleged that on seeing police party the petitioner had tried to escape.

Patna High Court Cr.Misc. No.29402 of 2018 (3) dt.29-06-2018 It has been submitted that nothing incriminating article has been recovered from conscious possession of the petitioner and the alleged explosive substance was recovered from an open field. None of the independent witness has supported the recovery of any substance from possession of the petitioner. The petitioner is in custody since 11.01.2018 having clean antecedent except a case registered for the offence under section 498A of I.P.C. The learned A.P.P. for the State opposed the submission.

Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned A.C.J.M. III, Gaya in connection with Konch P.S. Case No.03 of 2018.
