The petitioner seeks bail in connection with Baheri P.S. Case No.186 of 2012 registered under Sections 363, 365, 370, 376, 307 and 120(B)/34 of I.P.C.
Learned counsel for the petitioner submits that it would appear from the F.I.R. that the allegation is against one Rakesh Jha but during course of investigation after two years the informant filed an application to the effect that the person who kidnapped and raped was Rakesh Poddar son of Gango Poddar. He further submits that thereafter the petitioner was apprehended and remanded to judicial custody on 29.05.2017. Charge sheet has
Patna High Court Cr.Misc. No.46933 of 2017 (2) dt.06-10-2017 2/2 already been submitted against the petitioner. The informant has also filed a compromise petition in the trial court which would appear from the impugned order dated 27.07.2017 passed in B.P.No.451/17 by the 1st Additional Sessions Judge, Darbhanga whereby regular bail of the petitioner was rejected. Having considered the facts and the circumstances of the case, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Darbhanga, in connection with Baheri P.S. Case No.186 of 2012.
