====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 02-04-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Dighwara P.S. Case No.226 of 2012 instituted under Sections 341, 323, 504, 379, 34 of the Indian Penal Code.

3. As per prosecution case, the mobile of informant was stolen by co-accused Kulkul Kumar who is son of the petitioner when he came to deliver milk in the house of informant. It is alleged that when the informant went to his house to demand his mobile phone, the parents of co-accused Kulkul Kumar assaulted him by lathi and bricks and the petitioner also assaulted the informant by Axe causing injury on his forehead and a chain from his neck was also snatched by them.

Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case due to dispute arises between the parties with respect to calculation of sale price of milk. Learned counsel submits that the injury on the informant is simple in nature and after investigation, the Police submitted final form against the petitioner, however, cognizance has been taken by the learned Trial Court against the petitioner. He further submits that petitioner is an old lady suffering from ailments whose husband died due to serious heart disease and was unable to file this bail petition. Petitioner has no criminal antecedent and she undertakes to cooperate in the trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount to each to the satisfaction of the learned Judicial Magistrate, 1st Class, Saran at Chapra in connection with Dighwara P.S. Case No.226 of 2012, subject to
