Petitioner seeks bail in a case registered for the offences punishable under Sections 364/120(B)/34 of the Indian Penal Code.
Petitioner and others are suspected to have kidnapped to the son of the informant with intent to commit his murder. During investigation, it revealed that the victim had enmity with Bulbul Mishra and under a conspiracy, the petitioner took the deceased on his motorcycle and from behind the back, a four wheeler dashed against the motorcycle. The accused person travelling in the four wheeler took the deceased with them and fled away. There is no eye witness of the
Patna High Court CR. MISC. No.14750 of 2019(4) dt.15-05-2019 2/2 occurrence. Aforesaid material has appeared in the confessional statement of the petitioner and others. Petitioner is in custody since 12.10.2018. Investigation of the case is already complete. Learned counsel for the informant opposed the prayer for bail on the basis of material coming against the petitioner. Petitioner has got no criminal antecedent. Considering the entire facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Rivilganj Police Station Case No.320 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
