The petitioner apprehends his arrest in Saharsa P.S. Case no. 47 of 2015, registered for the offences punishable under Sections 420/406 and other Sections of the Indian Penal Code. The informant alleged that Chandra Kishore Yadav took money as commission for providing loan. When the informant got Rs. 35,000/-from the Bank, Chandra Kishore Yadav again snatched Rs. 12,000/- from her as commission. Chandra Kishore Yadav was arrested. He disclosed that he used to give money to the Manager of the Bank.
It is submitted that the occurrence took place outside the
Patna High Court Cr.Misc. No.16481 of 2015 (2) dt.30-04-2015 2/2 Bank premises, there is no material to show that the petitioner took money from the informant and any other customers. Name of the petitioner figured in the case in the extra judicial confessional statement of Chandra Kishore Yadav.
Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate in connection with Saharsa P.S. Case No. 47 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi/- U T
