The petitioner seeks bail in a case registered for offences under Sections 272 and 273 of the Indian Penal Code and Sections 30 (A), 38 and 41 of the Bihar Prohibition and Excise Act, 2016.

It is contended that as per allegation, 4 bottles each containing 375 ml, i.e, total 1.5 litres of foreign liquor were allegedly recovered from the possession of the petitioner. It is further contended that the petitioner is made accused in another case, i.e., Pupari P.S. Case No. 114 of 2017 for offences under Section 30(a) of Bihar Prohibition & Excise Act. It is

Considering the facts and the circumstances of the case, the petitioner, above named is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise Act, Sitamarhi in connection with Pupari P.S. Case No. 209 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
